YAKIMA, Wash. - The recall against Yakima council member, Rick Ensey will not go forward.
Judge Michael McCarthy presided over the hearing last Friday and after reviewing case law this weekend came to his decision.
McCarthy said, "In this case, on the very technical point that proof of a quorum is lacking, the Court believes these charges cannot be substantiated."
The petitioners tried to show that Ensey broke the open public meetings act by lining up votes to change the cities budgeting process. The judge does not believe a quorum of the council was present so Ensey did not break the act.
Judge McCarthy also added, " The Court would also add that it does not believe that Petitioners have acted frivolously, but with a genuine desire to right what they perceived to be a wrong."
