Pasco, WA- It appears a murder trial in the Tri-Cities may not get underway until next year, if at all.
Jose Garcia Morales had been scheduled to go to trial next month, but today a Franklin County Judge granted the defense team's request to send Morales to Eastern State Hospital for a second mental examination.
Because of the hospital's workload, that exam won't happen for six to eight weeks.
After an initial exam, a state psychiatrist declared Morales competent to stand trial, but the defense attorney says Morales' mental state has worsened.
Morales and his brother, Ramon Garcia Morales, are accused of shooting a Pasco man and wounding his wife last December while their two daughters watched.
Morales' brother is tentatively scheduled to go on trial later this fall.
