Pasco, WA- A judge has rejected a defense claim that Franklin County prosecutors violated the constitutional rights of a man accused of murder.
The attorneys for Vicente Ruiz asked for a mistrial today, arguing prosecutors intentionally brought up Ruiz's extradition from Mexico during the lead detective's testimony.
The defense says the word extradition suggests guilt.
Superior Court Judge Cameron Mitchell says he believes the jurors won't make any conclusions based on the detective's comments.
Mitchell today also refused to excuse a woman from the jury after she recognized the detective as a deputy marshal at the federal building where she works.
After interviewing the juror, the judge ruled there's no evidence the juror would be partial in any way.
