PASCO-- Delonde Pleasant, the man convicted of beating and killing his girlfriend, Juanita Montelongo back in March of 2002 was back in a Franklin County Court Room Friday. Pleasant, who is appealing his 25 and half year sentence says he can no longer afford his attorney and needs a court appointed lawyer. Douglass Phelps, Pleasant's attorney agreed to stay on the case but Franklin County needs to approve it. A judge gave him the excessive 25 1/2 sentence due to the violent nature of the second degree manslaughter. New law states that if a sentence is going to be excessive, as the standard sentence for such a crime is 6 1/2- 8 1/8 years, a jury must find the crime excessive as well. Pleasant's is appealing the judge's sentencing, so a jury panel must be formed to decide if his crime was indeed excessive. The hearing to chose a jury is scheduled for August 12th.
