PASCO, WA- A man trying to shorten his prison sentence will have to wait until the judge in the case finishes another trial.
A judge sentenced Delonde Pleasant to prison eight years ago for the beating death of his girlfriend, Juanita Montelongo. An appeals court overturned the 25 year sentence based on a legal technicality.
Pleasant's attorneys argue the man has served sufficient time.
The re-sentencing trial had been scheduled to begin next month, but a forensic expert, a key prosecution witness, is currently out of the country and won't be available to testify until mid November. By then, Judge Cameron Mitchell will be presiding over the murder trial of Vicente Ruiz. As a result of a change of venue, that trial has been moved to Spokane.
Mitchell has rescheduled Pleasant's sentencing trial for February.
