PASCO, WA- A Franklin County judge is scheduled to make a ruling next week on whether to drop charges against a man accused of murdering his pregnant former girlfriend.
Kurtis Chapman is also charged with manslaughter for the woman's unborn child, but his attorney, Mathew Rutt, wants all charges dropped, arguing Pasco police violated Chapman's civil rights.
Shortly after his arrest, a police detective eavesdropped on a jailhouse phone conversation between Chapman and his attorney. Rutt says the detective heard possible defense strategies and other privileged information.
Prosecutors say the detective made an honest mistake, and have suggested a solution would prohibit the detective from testifying at the trial.
