Prosecutor Will Not Charge Store Owner

WALLA WALLA, Wash. - The Walla Walla County prosecutor says he will not charge the owner of a store who shot and killed a man during a burglary.

An inquest jury ruled in a 4-2 decision Friday the shooting was justifiable homicide.

Prosecutor Jim Nagle said Monday the verdict showed how difficult it would be to prosecute the case.

The owner of the New York Store Western Outfitters, John Saul, shot Cesar Chavira on May 4 after he broke in and stole belts and belt buckles.

A lawyer for Chavira's family says they plan to file a civil lawsuit against Saul.
