Judge to decide whether victim's statements are hearsay or evidence
PASCO, Wash.- Prosecutors and defense attorneys are set to argue whether what a woman told her neighbors before her death can be used as evidence.
Attorneys for Tashia and Todd Stuart argue what Judy Hebert said must be considered hearsay.The defense team also wants Franklin County Superior Court Judge Cameron Mitchell to suppress statements made by the Stuart's young child. Mitchell will hear the arguments next Wednesday.
Pasco police arrested Tashia Stuart last year after she shot her adoptive mother. Stuart claims self defense.
Stuart's husband, Todd Stuart, is accused of trying to kill Hebert a month earlier.
The stuarts' trials are scheduled to begin this fall.
