Former Kennewick Gym Owner Not Guilty

KENNEWICK, Wash. - A Benton County jury has found former 509 Fitness Gym owner Jason Sleater not guilty on one count of first degree theft and one count of second degree theft.
The jurors said they could not reach a decision six other second degree theft charges, and the judge declared a mistrial for those. Prosecutor Terry Bloor said the state may consider retrying Sleater on the six charges the jury couldn't reach a decision on. Sleater was accused of taking almost $20 from nearly 400 gym members' debit or credit cards in the form of an enhancement fee, and then closing the gym without offering refunds. The prosecution said Sleater had no authorization to make the withdrawals, but the defense argued it was a case of revenge because one of the alleged victims is a Kennewick police officer. The defense also felt the case should have been a civil matter instead of criminal.
