Driver of car that struck boys has history of drug use

Yakima, WASH.--The driver of the car who hit the young boys, 32-year old Benjamin McKenzie, made his first court appearance Tuesday.

Yakima Police said McKenzie was under the influence of a mixture of drugs when he hit the two victims.

After the accident, he was examined by a Drug Recognition Expert, and from there police obtained a blood sample.

McKenzie has a history of drug use.

It was announced in the courtroom that he was convicted of a felony drug charge in 2009, and there's been three warrants out for his arrest.    

His court records also show he's had a history of using meth.

"There was a combination of drugs that was impairing him that we believe at this time, and we've just been waiting for the toxicology results to come back from the state criminal lab," said Sgt. Shawn Boyle of the Yakima Police Department.

At McKenzie's preliminary appearance, the judge said there is probable cause that an offense has been committed.

The judge also said McKenzie is a concern to public safety and a flight-risk.

He's been charged with vehicular assault, and bail was set at $500,000.

McKenzie's arraignment date is scheduled for Tuesday, October 30th.
