Business ethics issues arise in Sarasota as the landscaper alleges that Dieter’s overcharged Turner Tree on more than 40 projects.

Local business ethics is at the heart of many of Sarasota’s lawsuits every year. Turner Tree and Landscape has filed a lawsuit against Dieter’s Sod Service, seeking more than $87,000 in damages and $14,267.03 in attorneys’ fees.
The lawsuit alleges that Dieter’s Sod Service, whom Turner Tree had hired to provide residential and commercial sod and seeding installation, intentionally provided less square footage of sod and seeding than promised on more than 40 different projects over the past three years.
Darrell Turner, owner of Turner Tree and Landscape, said that business ethics is very important to Turner Tree and that the alleged lack of ethical behavior by Dieter Sod came to light after it asked Turner Tree to pay a $5,800 cost overrun in May 2012 on a Lakewood Ranch apartment complex project.
Turner Tree paid the cost overrun but also re-measured the project. Turner said his company’s measurements then evidenced that Turner Tree had been overcharged by Dieter’s Sod Service.
“The original case prompted Turner Tree to review other projects completed by Dieter’s Sod for Turner Tree over the last three years and this appeared to be a pattern of conduct,” Darrell Turner said. “The results have been shocking.”
Turner, whose company is one of dozens of local contractors looking for sod, said he filed suit only after four failed settlement attempts with Dieter’s Sod Service.
Turner Tree and Landscape has retained Mackey Law Group in prosecuting Manatee County Circuit Court Case No. 2012 CA 7308. “We have reviewed the underlying documentation of Turner Tree’s claim and are confident that Turner Tree will prevail against Dieter’s Sod Service,” said attorney Peter J. Mackey.
