Prosecutors to Determine Whether Finley Shooting is Justified

FINLEY, Wash. - Prosecutors are trying to decide if Friday's shooting in Finley on East Bowles Road is justified.

Detectives say there was an argument and fight between 74-year-old Oliver Smith and his stepson 53-year-old Jerry Barton over a cattle chute. Smith's grandson, 24-year-old Tim Brown, ran over to help him.

That is when deputies say Brown fired warning shots in the air and then Barton lunged at Brown. During a struggle, Brown's gun went off again and hit Barton in the chest.

Barton died at the scene and Smith was taken to a hospital for treatment.

Prosecutors say it could be several weeks before they decide whether the shooting was justified or if they plan to file charges.
