Defense Wants Prosecutor Removed from Murder Trial

PASCO, Wash.-Defense lawyers representing a woman on trial for murder want the prosecutor thrown off the case and the judge to declare a mistrial.

Franklin County prosecutor Shawn Sant Friday conceded to the judge it appears he didn't include in a written summary to the defense information provided by a witness.

The witness testified Thursday in the trial of Tashia Stuart.

Defense attorney Bob Thompson says Sant should now be considered a witness in order to substantiate or refute the witness's testimony.

Outside the presence of the jury, Thompson, arguing the state violated discovery rules, questioned Sant's professional conduct.

Superior Court Judge Cameron Mitchell dismissed the jury Friday, told all attorneys to send him written arguments over the weekend, and says he'll rule Monday whether to remove the prosecutor from the case and declare a mistrial.

Stuart is accused of murdering her mother, Judy Hebert, in March 2011. Stuart Claims self defense.
