Ex-Husband to Testify in Franklin Co. Murder Trial

PASCO, Wash. - Jurors will wait a little longer to hear from the ex-husband of a Pasco woman on trial for murder.

Todd Stuart was in the courtroom Tuesday when attorneys for both sides argued over whether he can take the stand in Tashia Stuart's murder trial without jeopardizing himself.

Todd Stuart was acquitted on attempted murder charges last year in connection with an incident where a bin full of books fell on Judy Hebert's head. Tashia Stuart shot and killed Hebert a few weeks later.

An attorney representing Todd Stuart told the judge Tuesday that testifying could make his client vulnerable to new charges.

"Extreme collateral consequences. Not just collateral consequences. I think were looking at Mr. Stuart as a regular witness. But were talking about an accused co-defendant of this case," said Attorney Peyman Younesi.

The judge ruled Tuesday that Stuart will have to testify but it is unclear when he will take the stand. His attorney says he needs to be back in California for school Thursday.
