Estranged Husband Testifies in Murder Trial

Posted: Updated:

PASCO, Wash. - The estranged husband of a woman on trial for murder evoked his Fifth Amendment right when he testified Wednesday.

Todd Stuart conferred with his lawyer sitting at his side before answering questions from attorneys representing Tashia Stuart, accused of murdering her mother, Judy Hebert, in her Pasco home in March 2011.

Stuart says he didn't conspire with his wife to kill his mother-in-law, but he refused to answer several other questions, asserting his right not to incriminate himself.

A Franklin County jury acquitted Todd Stuart last year of conspiracy charges.

Stuart says he is married but separated from Tashia Stuart. He now lives in California.

Defense attorneys plan to call Tashia Stuart to the stand later this week. Stuart claims she shot her mother in self-defense.
