After Two Murder Mis-Trials Spokane Man May Avoid 3rd Trial With Plea Deal

KHQ.COM - After two murder mis-trials Daniel Lazcano may avoid 3rd trial with plea deal. Lazcano's defense attorney Eric Christianson tells KHQ's Dylan Wohlenhaus that Lazcano will not be tried a third time. "The county was willing to go to a third trial but both sides came to an agreement" Christianson says.

Christianson would not say what exactly the charge Lazcano agreed to but says "It's a significant reduction" to the 1st degree murder charge and kidnapping charge Lazcano was tried twice for. During his first trial Lazcano was convicted of improperly disposing of a body which is a misdemeanor.  

KHQ's Dylan Wohlenhaus spoke to Whitman County prosecutor Dennis Tracy who says "both sides have been discussing some sort of deal" but would not confirm a plea agreement had been met saying it has not yet been presented to a judge.

Tracy also says in general terms its possible in cases where plea agreements have been met the defendant can "back out" before its been finalized by a judge.  

Lazcano was being tried for the murder of Rosalia resident Marcus Schur in 2011. Daniel's brother Frank Lazcano Jr. is serving a 25 year sentence in prison in connection with Schur's murder.
