PASCO, Wash. -- A man convicted of 2nd Degree Rape in 2009 was back in Franklin County Court Thursday morning to point out an error in his original judgement and sentencing.
David Webster was convicted of raping his cellmate in 2003 while in the Franklin County Jail.
He says there was a judicial error in his original judgement and sentencing which he believed could lead to a dismissal of his 2009 conviction. He was charged with three counts of rape and was convicted on count three; his judgement and sentencing says he was convicted on count one.
Judge Cameron Mitchell ruled it was simply a clerical error.
Webster chose to represent himself at the motion hearing. He has 245 months to life left in prison.
