UPDATE: Jury Finds Spokane Man Guilty Of Molesting Girl At Northtown Mall

UPDATE: 55-year-old Richard Payne was found guilty on Tuesday morning on the 3 felony charges he was on trial for. They include 1st degree child molestation and indecent exposure. The jury deliberated for only 3 hours before reaching a verdict.

After the verdict was read Payne's attorney, Dave Hearrean immediately asked the judge for a new trial. Payne and his attorney will have to file the proper paperwork to do so.

Hearrean will file an appeal, he says within 30 days. Hearrean said Payne's confession only came after detectives intimidated him and coerced him in to giving a statement. Hearrean also said that Payne did not get a fair trial because the jury got to hear about Payne's conviction in 2001 for sexually touching a 9 year old girl at a North Spokane store. Payne was convicted for that crime and spent more than 3 years in prison before registering as a level 3 sex offender.
 
Prosecutors argued that they believed Payne was dangerous and very likely to re-offend. During the trial Payne testified in his defense. Prosecutors called Payne's claims "ridiculous" after he stated he had no interest in the children at the Bumpers video arcade inside the Northtown mall where the incident occurred. Payne will likely face life in prison for Tuesdays conviction.

KHQ.COM - The Defense began it's case Monday morning in the trial of Richard Payne, the man accused of molesting a young girl at the video arcade inside the Northtown Mall. Payne defended himself by saying that he was at the video arcade in the mall because he had lost $1,500 early in the day at the Coeur d Alene Casino.

He told the jury that he was upset about losing so much money and was wandering the mall thinking about how he would tell his girlfriend. Payne stated multiple times that he did not seek contact with any children at the video arcade.  

The Prosecution disagrees and believes that the surveillance video shows that Payne entered the video arcade and approached the children and inappropriately touched the youngest.girl. It is the Prosecution's belief that the surveillance video also shows Payne zipping up his pants after the encounter.  

The jury will hear closing statements from both sides Monday afternoon and will begin deliberations. If convicted, Richard Payne could receive a life sentence.

UPDATE: After the testimony of a 12-year-old girl, the state has rested its case against Richard Payne, the man police believe molested a girl at the Northtown Mall a year ago. The 12-year-old who testified was a witness for the state.

KHQ.COM - Prosecutors called several witnesses to the stand at the Spokane County Courthouse Wednesday as the trial for Richard Payne entered its third day.

Payne is accused of reaching up a 5-year-old girls's skirt and exposing his genitals at an arcade inside the Northtown Mall in June 2012, and is facing two counts of child molestation and one count of indecent exposure.

Spokane Police Detective Jerry Hensley interviewed Payne after identifying him in security video taken in the arcade. He testified Wednesday that when he first asked Payne about it, he replied, "I don't know what you're talking about."

But when Hensley told him about the video, he changed his story:

"He said he did touch the girl on the buttocks," Hensley testified. "He added he did not go to the mall intending to touch a child it was just an opportunity that presented itself."

This isn't the first time Payne has been facing similar charges.

Also on the stand Wednesday was a girl who says Payne molested her inside a 99 cent store in Spokane in 2001, when she was just 9 years old.

Her mother testified her two children were in the store with her that day, and her daughter was looking at something in a nearby aisle. She told the court she was only out of her sight for a minute or two when she came back trembling.

"I asked her, 'What was wrong?' and she pointed to a man who was exiting a store at that time and said, 'That man touched me.'"

Payne was held by a cashier for police and the girl identified him as the man who touched her.

He was convicted in the case.

Payne has pleaded not guilty to these new charges and is expected to take the stand in his own defense next week.
