PENDLETON, OR - Police say a 74-year-old Pendleton woman fired a warning shot to scare off a man who attacked her with a skateboard.

Police Chief Stuart Roberts says Nancy Ashworth was walking near a skate park when a dog not on a leash came at her aggressively. She used pepper spray on the dog,  upsetting 23-year-old Justin Doss.

Doss is accused of then hitting the woman in the head with his skateboard. That's when she pulled out her .38 caliber revolver.

A grand jury indicted Doss this week on charges of assault, menacing, disorderly conduct and recklessly endangering another person.

The chief says Ashworth has a permit to carry a concealed weapon, and the incident could have been avoided if the dog had been on a leash.
