Serial Rape Trial Over -- Guilty

The jury reached a verdict on Monday in the trial of the serial rapist Toby Griego.

He was found guilty on all 27 counts including three rapes and one attempted rape.

"On count one -- guilty. Count two -- guilty."

After nearly four hours of deliberation, the jury reached a unanimous verdict, Toby Griego is guilty on all 27 counts.

"I'm feeling great. It is a great verdict. I certainly thank the jury for all their hard work, sitting there for the last several days, piecing through all of that very difficult evidence," says Rod Souza, the Chief Deputy County Attorney who prosecuted the case.

The state started its closing argument first with Rod Souza going over the evidence presented through testimonies from the trial.

Souza talked about the evidence found on Griego's cell phone.

"You have something so much more powerful than fingerprints, more powerful than DNA, more powerful than any forensic evidence. You've got a movie of the crimes. You've got photographs taken first person by the person committing the crimes."

Souza asserted the prosecution did prove Griego committed all 27 crimes.

"This. That is the face of evil. That is the face of a man who perpetrated these horrible crimes ... we satisfied our burden. It really is that simple. The evidence is overwhelming"

The defense reminded jurors to consider each of the 27 charges as individual counts.

"Specifically, the defense believes the state has failed to prove its case and that there are certain counts of the 27 that it's easy to determine they had done so," says Public Defender Tom Bartleson. He contested some of the counts, including the robbery charges.

"At some point, items were taken. We're not sure when, and they have not proved that at that time the victim was placed in fear."

In a rebuttal, prosecutor Juli Pierce argued the victims feared for their lives the entire time.

"He is your eyewitness. Hold him accountable for his reign of terror and find him guilty of all 27 charges," says Pierce, Senior Deputy County Attorney.

The state is requesting a special sentencing hearing, where victims may testify.

In the meantime, a psychosexual evaluation will be prepared.

Judge Russell Fagg says a sentencing date will be set in the near future.
