UPDATE: BOISE, Idaho (AP) - Nearly 200 gay rights supporters have flocked the steps of a Boise, Idaho, courthouse in celebration and protest over the latest development in a same-sex marriage lawsuit.

Friday's rally originally was planned as a party when a federal judge overturned the state's same-sex marriage ban earlier this week. The judge said couples could marry starting Friday morning.

By Thursday, however, the ruling was temporarily placed on hold while an appellate court reviews the case.

Boise resident Selina Heck calls the delay disappointing but says she and her partner of 19 years hope they'll be allowed to marry soon.

Gay marriage is legal in 17 states and the District of Columbia; same-sex marriage bans in several other states are being struck down in the courts at a brisk clip.

UPDATE:
BOISE, Idaho (AP) - A federal appeals court has temporarily put plans for Idaho same-sex weddings on hold while it considers the state's request for a longer stay.

The state's gay marriage ban was overturned Tuesday when U.S. District Judge Candy Dale said the law unconstitutionally denied gay and lesbian residents their fundamental right to marry. Dale said Idaho must begin issuing marriage licenses to same-sex couples starting Friday morning.

But the 9th U.S. Circuit Court of Appeals on Thursday put the weddings on hold while it considers a request for a longer stay while the governor and attorney general appeal the case.

The four couples who sued to get Idaho's ban overturned had asked the court to allow the weddings to begin.

UPDATE:
BOISE, Idaho (AP) - Idaho officials say they will ask the 9th U.S. Circuit Court of Appeals for an emergency stay while they fight a federal judge's decision to allow same-sex marriages in the state starting on Friday.

U.S. District Magistrate Judge Candy Dale overturned Idaho's ban on same-sex marriages Tuesday, and on Wednesday she refused to put pending marriages on hold while Gov. C.L. "Butch" Otter and Attorney General Lawrence Wasden appeal.

Matrimonial law expert Seymour Reisman said the appellate court is likely to issue the stay, and the U.S. Supreme Court is almost certain to take up the matter.

Former state Sen. Nicole LeFavor says gay couples would still be open to housing and employment discrimination because they are not covered by Idaho's Human Rights Act.

The Idaho Republican Party issued a statement reaffirming the organization's stance against same-sex marriage.

UPDATE:
BOISE, Idaho (AP) - A federal magistrate judge has refused to put gay marriages on hold in Idaho pending an appeal from the state's governor.

U.S. District Magistrate Judge Candy Dale wrote Wednesday morning that Gov. C.L. "Butch" Otter's appeal isn't likely to succeed, and so there's no reason to keep same-sex couples from seeking marriage licenses or marrying on Friday.

On Tuesday, Dale struck down Idaho's same-sex marriage ban in response to a lawsuit from four Idaho couples.

Dale said Idaho's law unconstitutionally denies gay and lesbian couples their fundamental right to marry and wrongly stigmatizes their families. She said the state must start issuing marriage licenses to same-sex couples Friday morning.

Gay marriage is legal in 17 states and the District of Columbia.

Otter has vowed to appeal the ruling.

PREVIOUS COVERAGE:

BOISE, Idaho (AP) - Gay and lesbian couples in Idaho could start getting married as soon as Friday, after a judge ruled the state's ban on same-sex marriage is unconstitutional.

U.S. District Magistrate Judge Candy Dale wrote in her decision that Idaho's laws barring same-sex marriage unconstitutionally deny gay and lesbian citizens their fundamental right to marry.

Dale says the state must issue marriage licenses to same-sex couples starting at 9 a.m. Friday.

Gov. C.L. "Butch" Otter already has said he intends to appeal the case, meaning an appellate court could still put the weddings on hold.

Dale says the ban wrongly stigmatizes gay and lesbian couples and relegates their families to second-class status.
