TERRACE HEIGHTS, WA - Yakima County deputies are now filing a weapons assault charge against the man who fired a gun at two people trying to break into his car.

July 6th the 18-year-old saw two men trying to break into his car and steal personal items.

Deputies said he shot at the two prowlers hitting one in the leg and sending him to the hospital.

The shooter was never arrested and it seemed like that's where the case ended, but after an investigation, deputies now say the 18-year-old could face felony weapons assault charges for shooting the 17-year-old prowler.

Detective Mike Russell with the sheriff's office said it is a technicality, but the charges are justifiable.

"It's just quite frankly a matter where you can not shoot someone unless you're protecting your life or someone else's life, and in this case there is nothing to suggest those factors were met," said Detective Mike Russell with the Yakima Sheriff's Office.

He also said this will go to the prosecuting attorney's office for further evaluation.

If prosecutors don't think there is enough evidence from the investigation, then there will be no charges filed against the 18-year-old.
