Sunnyside Pot Store Mulls Lawsuit After City Council Extends Moratorium

YAKIMA, WA. -- A legal battle over marijuana could be coming to our region after the Sunnyside City Council narrowly voted to extend their marijuana moratorium. 


Dave's Place is a state licensed marijuana retail store in Sunnyside. It's owned by the same people that started Randum Gifts and Novelties right next door. 


Dave's Place isn't open and might not be open for some time due to the recent actions of the Sunnyside City Council. But the owners are fighting back. 


We reached to the lawyer who represents the owner of Dave's Place, Dave Rand, after the city council voted 4 to 3 in favor of extending a marijuana moratorium.


In an email, Attorney Alex Newhouse said, "At this time we are evaluating all of our options and are hoping for some sort of compromise. A lawsuit is likely but not a certainty."


We sat down with Sunnyside City Manager Donald Day who said he agrees with the city council's cautious approach.


"This isn't about Seattle or Spokane, it's about Sunnyside," Day said. "And the folks here want the decision done right. They don't want to jump into a situation they can't get back out of I don't think."


For now, the City of Sunnyside moves forward with plans to write up another 6-month moratorium on marijuana. Meanwhile Dave Rand hopes they can come to a compromise and someday get Dave's Place open for business.
