KENNEWICK, WA - A deputy and police officer were cleared by Benton County prosecutor for fatal May shooting of  a Kennewick man during a hostage situation.

Benton County Prosecutor Andy Miller said Wednesday that the officer involved shooting death was justified on May 4 of 36-year-old Roark Cook.

Officers responded to Cook's apartment when his mother called 911 and said she was worried he'd hurt someone. A SWAT team responded after Cook told officers through the closed door of his apartment that he had a gun.

Two women and a 7-year-old boy escaped over the apartment balcony as officers shielded them from at least one bullet fired by Cook.

Cook died after gunfire exchange with Benton County Deputy Logan Brown and Richland police Officer Ryan Miller.
