KENNEWICK, Wash.- Optometrist testimony from Pastor Randall Foos's civil trial was the issue of contention.
His defense argued that a series of medical witnesses should not be allowed due to doctor-patient privledge.
The prosecution argues that preventing certain witnesses would be a pick-and-choose situation for the defense.
A judge will allow testimony from the key witnesses, but will re-examine several of the motions at trial.
Jury selection is set for Monday, August 14, with testimony slated to begin August 15.
