County Will Have to Bring in Judge to Retry Hilton
KENNEWICK, Wash.- The re-trial for accussed murderer Kevin Hilton may have to move out of Benton County.
Judge Craig Matheson was recused from the case Friday at the request of Hilton's attorneys.
Matheson was the only Benton County judge left to take the case after it circulated through all others.
The courts will now have to decide whether to bring in an outside judge, or possibly move the case.
"I think there's a procedure where the administrator for the courts can assign, and that's sort of the predicament we're in now with no judge remaining in this county or these counties to exercise discretion over this cas," Matheson said.
A jury convicted Kevin Hilton of killing his landlords in 2003, but an appeals court overturned the conviction saying evidence used at trial was obtained with an overly broad search warrant.
