SPOKANE, Wash. (AP) - A state appeals court has upheld the ruling that overturned a 1995 rape conviction in Yakima.
Ted L. Bradford completed a 9-year prison sentence, but always maintained he was innocent.
An appeals court in Spokane agreed yesterday that a jury would have let Bradford go free had it known the DNA profile of another man was found on a mask used in the attack.
The Yakima County prosecutor is deciding whether to appeal to the Supreme Court and may retry the case.
