Judge Refuses to Throw Out Russell DUI Charges

COLFAX, Wash.- A judge has refused a defense request to dismiss vehicular manslaughter charges against accused drunk driver Fred Russell.

Whitman County Superior Court Judge David Frazier now says Russell will stand trial for three counts of vehicular homicide and three counts of vehicular assault.

Frazier also moved the trial to Kelso because of extensive press coverage in Whitman County.

Russell is accused of driving drunk and killing three Washington State University students on the Pullman-Moscow Highway in 2001.

Russell's defense had asked charges in the case be thrown out after the state destroyed blood samples after testing.
