Initiative 747 Overturned by State Supreme Court

KENNEWICK, Wash.- The State Supreme Court has overturned a landmark Tim Eyman initiative.

Initiative 747 limited property tax increases to 1% each year.

Governor Christine Gregoire is already asking the legislature to put a new cap on property tax increases.

The State Supreme Court ruled Thursday that the initiative "misled" voters, and because of that was unconstitutional.

Multiple Citizens groups had sued claiming the initiative misled voters.

"We're especially delighted with the emphasis the court placed on the right of voters to be fairly informed on what they're voting on as opposed to the rights of people who want to pass initiatives," said Keith Scully, Legal Director for Firewise, one of the groups that sued. 

Legal analysts say the decision sets a precedent in the initiative process by ruling initiatives that are found to be lies, unconstitutional.
